Constitution critiques wanted

So I was over looking my nation's Constitution and was doing some building and would like some critiques on it or suggestions on it.

 

Prelude: Our nation of the Brotherhood of Kyro which is made up of the states of Mongolia, Green Day, Ottowa, Rhodesia, Vietnam, Czechoslovakia, Kansapolis, Cambria, Cambin, Ireland, Koland, and Majestiria join together to form a more perfect union in order to increase the welfare of our citizens.

 

Article 1: In order for the citizens of Kyro to feel safe and secure the federal government must gurrientee them certain rights. The rights must include the freedom of religion, the freedom of speech, the freedom of privacy, the freedom and pursuit of happiness, and the freedom from fear.

 

Article 2: The National capital of the Brotherhood of Kyro is Ft. Chackees. This nation shall be a Capitalist nation that shall protect the right of property for their citizens to be able to own property. 

 

Article 3: It must take the Brotherhood of Kyro a 3/5’s vote to pass a law or annex a territory. The Congress of Kyro has the power to declare war on another nation. The Kyrian Congress will be unicameral which will contain the state’s governor and a senator who is from the state. Elections for a governor is every 2 years, elections for Senators are every 3 years, and the elections for the Kyrian President is every 4 years. The President of Kyro has the right to select a Kyro cabinet.

 

Article 4: The main text of the Brotherhood of Kyro Constitution shall not be changed. Only amendments may be added to the Constitution with a 3/5's vote from the Kyrian Congress as well as 3/5's of the Kyrian states. 

 

Article 5: No laws made by the states shall interfere with any federal law or the Kyro Constitution.

 

Article 6: The Brotherhood of Kyro shall be a Capitalist nation. The federal government shall monitor and regulate taxes, the Kyro Stock Exchange, and criminal laws. The planning of a just economic just system.

 

Article 7: The Brotherhood of Kyro shall establish a federal court system for Constitutional conflicts and interstate/major crimes. The Supreme Court will interpret laws and have the power of judicial review where the Court will and can repeal laws that are passed that are unconstitutional. There will be 3 Supreme Court Justices and they will be nominated by the president then ratified by the Congress of the Kyro. Court Justices serve until they step down or die.

 

Article 8: The President will be allowed to vote on bills in Congress and has the ability to veto a bill passed by Congress. The President’s veto may be over ridden by a 3/5's vote by Congress.

 

Article 9: With a 3/5's vote from all the states they may create the Convention of States where delegates from the states shall meet together to create changes to the Kyrian Constitution, which must also be approved by 3/5's of the Kyrian states.


(Feb. 22nd, 2011) 
 

1st Amendment (May 3rd, 2012)
 

Article 1: The federal government has the right to build and maintain a military. The military members will be tax exempt after they had served in the military for at least 4 years and have not been discharged from their service branch.
 

Article 2: The Kyro citizens have the right to bear arms. The Kyro federal government cannot take the guns away from its citizens without reason, but they have the right to regulate weaponry. Kyro cannot tax weapons.
 

Article 3: Slavery, the bondage of another human being, against his or her rule shall be hereby illegal in the Brotherhood of Kyro.
 

Article 4: Everyone above the age of 16 has the right to vote. There are no barriers on voting except on whether or not they said person is imprisoned then they are not allotted the right to vote.
 

2nd Amendment (September 9th 2012)
 

Article 1: The Federal government of Kyro is above the states to the point where when the federal government passes a law the state’s law is nullified. Local governments and the federal government cannot try to dissolve each other. The Federal government and/ or the states can’t pass ex post facto laws. States are permitted to make their own laws and constitution as long as it does not contradict the Kyrian constitution.

 

Article 2: The Federal government has the right to regulate trade. Once something has traveled out of a state and is interstate then it’s a Federal responsibility. The Kyrian federal government can post economic sanctions against other nations. States are not permitted to post sanctions against each other.

 

3rd Amendment (October 11th, 2012)
 

Article 1: The citizens of Kyro have the right to the freedom of the television and the freedom of the internet. The government shall not place censorship on the airwaves or on the internet. The government has the right to watch the citizens of Kyro and track their history in order to track down possible terrorists.

 

Article 2: The citizens of Kyro have the right to peacefully assemble as long as it does not protrude other’s rights and does not disturb the peace.

 

4th Amendment (February 3rd 2013)
 

Article 1: Kyro must have a set balanced budget every 5 years and the nation must meet the spending deadline by 1 year at the minimum in as a just in case.
 

Article 2: The Brotherhood of Kyro must not go into debt. The nation’s debt must not protrude the nation’s debt ceiling that of which is $10,000. If the nation goes into debt than the nation must quickly get out in a 3 year time period before an automatic audit is placed on the nation to pay off the debt to get it under the Debt Ceiling.

 

5th Amendment (September 16th, 2014)

 

Article 1: The accused have the right to a trial by jury, a judge to precide over the trial, the right to a speedy trial so that they may not be innocent and jailed for too long. Right to have a lawyer.
 

Article 2: The military may not force upon the people of Kyro the quatering of it’s military and/or military equipment on their property or in their homes.
 

Article 3: The police and any government agency must have a valid warrant to search any homes and/or property.

 

 

 

 

Death Penalty Authorization Act
Article 1: The Kyro federal government herby authorizes the use of the death penalty for use in all Kyrian states.
Article 2: The crimes that the death penalty may be used for are outlined in the COCA bill passed in 2011. No crimes that are not rated at level 3 may be permitted for the death penalty
Article 3: The states may allow their prisoners to pick a humane death penalty that is listed below, if they desire. If the states decides against it then the state may select from the fallowing list of permitted death penalties.
- Lethal Injection
- Death via Carbon Sulfuric Gas
- Waterboarding
- Hanging
- Electric Chair
- Firing Squad
Article 4: If firing squad is picked and the person lives through it, the process is repeated until the person dies. For hanging, the prisoner is hung from the neck until proclaimed dead, by a certified doctor. Hangings will only done by local law enforcement, on duty military policy, and/or government personnel. 
Article 5: The death penalty may be only used if the judge authorizes it and the jury rules unanimously in favor. (12-0 vote)
Article 6: This bill shall be administered by the Judicial Branch and necessary Amendments maybe added to this bill.
Article 7: This bill shall go into effect immediately upon passage and all laws in interference with this bill shall be stricken null and void.

I am still clueless on that cult.

 

It's not a cult, it's a religion.Totally different. Dio is an all loving God who looks after those who are awesome enough to look after themselves. Also Mensa is awesome.

Though the fact is that this is not a theocracy.

In Arabia we use beheading as it gives an instant death. Far more humane

Executions are old style and inhumane. If you're going for an older theme, it's cool though. Pretty well written though, even if I disagree with a few things :P

Though there may be some differences on the Death Penalty, but I'm currious as to your suggestions for it though?

Article 3: Criminals can be enslaved depending on state’s law. People cannot be enslaved based on race, sex, religion, or sexual orientation.

^ What is this nonsense? Stooping to the level of the murderer now are we? I recommend that you get rid of it. Let the criminal contemplate what he did for a lifetime instead of killing him outright. If killing him is some sort of revenge, then there's something wrong with your society. Justice is not supposed to be used for revenge. Let him pay the consequences, but to kill him out of anger at him is barbaric. Let his conscience torture him. If he's a sociopath, his being locked in a cell will serve as a good punishment anyways as well as keeping him off the streets. This is assuming that this is out of revenge, as I don't see why else you'd want to kill someone as a direct result of their actions. But the line is drawn at execution. You're killing your own people when you do this. Have you forgotten that even a man who rapes or murders is still human? As such, he still has a right to live. You're still ending a man's life regardless of what he has done. This is especially a problem with capitalism, because now a disproportionate number of people who live in poverty or live in a !@#$ed up neighborhood might be at a disadvantange. I don't know what the culture or social climate is like in Kyro. But with capitalism, comes a lot more crime. Are these people, who have acted out necessity due to their desperate conditions, to be punished with death? Think about it.

 

And get rid of that slavery nonsense as well. Especially seeing how vague this is. What kind of criminal? Is the enslavement of an orphaned child who steals an orange to feed himself suddenly enabled? Why is he lumped in with the rapists and murderers? Enslavement by whom? For how long?

And WHEN are they enslaved?? Can they still be enslaved just for having a criminal record, despite having served their time? Or do they have to have not been prosecuted for enslavement to be legal? Are they hauled out of their prison cells without warning and legally sold into slavery? Are you aware that you will also have innocent men who have been convicted who will be enslaved?

 

This part of your constitution is scarily vague. Either redo it, or get rid of it.......but until then, I don't know if I'd ever want to visit your country or spend a single dime as a tourist.

Preferably get rid of it, as this is state-sanctioned slavery.

"But Jeremy!" someone might say, "Once they've committed murder then they've given up that right."

 

Then for !@#$'s sake, life is not a right, it's a privilege!!

Awe yes, thanks for the input. To be 100% honnest slavery was abolished in the Abolition Act (I would pull it up, but the page it's on is down for some reason) and was done in 2014. I must have forgotten to take it out of the Constitution. Nevertheless, I thank you for bringing this up to me as I would have not known.

 

I can agree with you that it probably shouldn't be in the Constitution, the death penalty act, but yet it is up to the people to decide what they want and whether they want it or not. That's how democracy works.

Unfortunately... In that sense, try to reform your society. Struggle with them, convince them that the death penalty is wrong.

Very true, though do you have any things that you believe might have been excluded that might need to be in there?

 

Well I would, but the policies of the Government had been very right leaning. We have:

Constitution Party: 1

Democrat Party: 3

Federalistist: 2

Independents: 4

LCAP (Libertarian-Civilized Anarchist Party): 2

Republican: 12

Socialist: 2

 

That is our Congressional Party members and our President is Republican. Even if I wanted to push anti-death penalty laws it would be hard to come by due to the large right wing representation.

Well I would, but the policies of the Government had been very right leaning. We have:

Constitution Party: 1

Democrat Party: 3

Federalistist: 2

Independents: 4

LCAP (Libertarian-Civilized Anarchist Party): 2

Republican: 12

Socialist: 2

 

That is our Congressional Party members and our President is Republican. Even if I wanted to push anti-death penalty laws it would be hard to come by due to the large right wing representation. 

Well the things I have are generally the result of a completely different kind of society that came about as the result of a violent revolution. It would probably conflict with the rest of your constitution O_o
